Minors can be charged daily fees

If a motor vehicle does not have the required third-party liability insurance, daily fees will be charged. This also applies if the owner or primary user of the vehicle is under 18 years old.

Under Danish road traffic law, it is the responsibility of the owner or the registered user to ensure that a vehicle is always covered by third-party liability insurance.

If a minor is registered as the owner or primary user of a vehicle – such as a moped, scooter or car – the insurance obligation also applies to the minor. This applies regardless of whether the vehicle is being used or not.

This means that if the vehicle is not insured, the minor can be charged daily fees.

Daily fees are a statutory consequence of a vehicle being registered without the required third-party liability insurance. Danish courts have therefore established that daily fees can legally be imposed on minors when they are registered as the owner or user of an uninsured vehicle.

DFIM does not contact the legal guardian

DFIM can only send letters and digital post to the person who is legally responsible for the vehicle – that is, the registered owner or user.

DFIM does not have access to information about legal guardians and cannot obtain this information from public authorities, The Danish Motor Vehicle Agency or other sources.

Therefore, DFIM:

  • cannot access or receive information about who the legal guardian is

  • cannot contact the legal guardian directly

  • cannot send payment requests or notices to the legal guardian

All communication is sent to the person registered as the user of the vehicle, who is also the person charged with the daily fees.

What should you do as a guardian or minor?

If you, or someone you are the legal guardian for, receive a letter from DFIM regarding payment of daily fees, it is important that you follow the instructions provided in the letter.

Daily fees will continue to accrue until the insurance requirement has been met or the vehicle has been deregistered. You should therefore:

  • pay the daily fees and insure the vehicle within 5 working days

  • deregister the vehicle if it is no longer in use

If the daily fees are not paid to DFIM, the case may be brought before the enforcement court. If the case concerns a minor, the court will generally summon or notify the legal guardian.

DFIM will only enter into payment agreements or instalment plans with a minor if the legal guardian has given consent.
